Agreement to Terms

By using the services of BayClean Channelview Landscaping, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services. These terms apply to all customers, whether residential or commercial, and govern all services we provide including lawn care, landscape design, installation, and maintenance.

Services Provided

BayClean Channelview Landscaping provides professional landscaping services including but not limited to lawn care and maintenance, landscape design and installation, hardscaping, irrigation systems, tree trimming and removal, sod installation, outdoor lighting, drainage solutions, yard cleanups, commercial landscaping, mulching, and artificial turf installation. All services are performed by trained and insured professionals.

We reserve the right to refuse service or cancel any project if we determine that the work requested is unsafe, illegal, or beyond our scope of expertise. Service details, pricing, and schedules will be confirmed in writing before work begins.

Pricing and Payment

All pricing is provided through written estimates or quotes. Estimates are valid for 30 days from the date issued unless otherwise specified. Prices may be subject to change if project scope changes or unforeseen conditions are discovered.

Payment terms will be specified in your service agreement. For one-time projects, payment is typically due upon completion unless other arrangements have been made. For recurring maintenance services, payment is due according to the schedule outlined in your service contract. We accept cash, checks, and major credit cards.

Late payments may be subject to a service fee. If payment is not received within 30 days of the due date, we reserve the right to suspend services until the account is brought current.

Scheduling and Cancellations

We will make every effort to arrive within the scheduled service window. Weather conditions, equipment issues, or other unforeseen circumstances may occasionally require us to reschedule. We will notify you as soon as possible if a schedule change is necessary.

If you need to cancel or reschedule a service, please provide at least 24 hours notice. Cancellations made with less than 24 hours notice may be subject to a cancellation fee. For recurring maintenance services, contract terms regarding cancellation will be specified in your service agreement.

Property Access and Safety

You agree to provide safe and unobstructed access to the areas where services will be performed. Please ensure that gates are unlocked, pets are secured, and sprinkler systems are turned off prior to our arrival. Any obstacles, hazards, or special instructions should be communicated to us in advance.

While we take every precaution to protect your property, you acknowledge that landscaping work involves the use of equipment and materials that can cause wear to certain surfaces. We are not responsible for damage to underground utilities, irrigation lines, or other items that are not clearly marked or disclosed to us prior to beginning work.

Liability and Insurance

BayClean Channelview Landscaping is fully licensed and insured. We carry general liability insurance and workers compensation insurance to protect both our customers and our employees. Our insurance covers property damage and injuries that may occur as a direct result of our work, subject to policy terms and conditions.

We are not liable for damage caused by hidden or unmarked utilities, pre-existing conditions, or damage resulting from circumstances beyond our control such as extreme weather events. Any claims for damage must be reported within 7 days of service completion.

Warranties and Guarantees

We stand behind the quality of our work. For installation projects including plants, sod, and hardscaping, we offer warranties as specified in your service agreement. Warranties typically cover defects in workmanship and materials but do not cover damage caused by improper maintenance, weather events, pests, or other factors outside our control.

Plant and sod warranties require that you follow our recommended care instructions, including proper watering. If you have concerns about the quality of our work, please contact us within the warranty period so we can address the issue promptly.

Privacy and Information Use

We respect your privacy and will not share your personal information with third parties except as necessary to provide our services or as required by law. Information collected through our website, phone calls, or service agreements is used solely for business purposes related to your landscaping services.

Dispute Resolution

If you have any concerns or disputes regarding our services, we encourage you to contact us directly so we can work together to find a solution. Most issues can be resolved through open communication. If a dispute cannot be resolved through direct communication, both parties agree to attempt mediation before pursuing legal action.

Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the updated terms. We encourage you to review these terms periodically.
